Liability & Food Safety Disclaimer

Last updated: July 13, 2026

READ CAREFULLY. Food Finder is a community platform that connects neighbors. Food Finder is not a food provider, food handler, restaurant, delivery service, or food safety inspector. We do not inspect, prepare, store, transport, test, or guarantee any food shared through the platform. We make no representations about the safety, quality, freshness, source, or fitness for consumption of any food. You use the platform and exchange food entirely at your own risk.

Federal Good Samaritan Protections

Good-faith donations of apparently wholesome food are protected from civil and criminal liability under the federal Bill Emerson Good Samaritan Food Donation Act of 1996 (42 U.S.C. § 1791), as expanded by the Food Donation Improvement Act of 2023. These laws shield individuals and entities — including platforms that facilitate food donation — from liability for harm arising from donated food, except in cases of gross negligence or intentional misconduct. Every U.S. state also has its own Good Samaritan food law that may provide additional protection. Nothing on this page is legal advice; consult an attorney about how these laws apply to you.

No guarantees

Food Finder makes no guarantee regarding:

  • the safety, freshness, or quality of any food;
  • the accuracy of any listing, including ingredients, allergens, or expiration;
  • the conduct, identity, or trustworthiness of any user;
  • the availability, uptime, or error-free operation of the website or app;
  • the outcome of any interaction or exchange between users.

Assumption of risk

By using Food Finder, you knowingly and voluntarily assume all risks associated with sharing, accepting, transporting, preparing, storing, and consuming food obtained through the platform — including risk of foodborne illness, allergic reaction, injury, property damage, or harm caused by other users.

Sharer responsibilities

  • Describe food honestly. Disclose all known allergens.
  • Follow all applicable food, health, and cottage food laws in your jurisdiction.
  • Do not share food you would not eat yourself.
  • Maintain safe handling, storage, and temperature.

Cottage food and home-kitchen laws

Many U.S. states have "cottage food" or home-kitchen laws that regulate how food prepared in a home kitchen can be shared or sold. These laws vary significantly by state and locality. Some states require registration, labeling, or caps on annual sales; others exempt certain low-risk foods from licensing entirely.

Food Finder does not monitor, enforce, or verify compliance with cottage food laws. Sharers are solely responsible for understanding and following the laws that apply in their specific city, county, and state. If you are unsure whether your food requires a permit, license, or specific labeling, contact your local health department or a qualified attorney.

Finder responsibilities

  • Inspect food before accepting and consuming.
  • Ask about ingredients, allergens, and preparation if you are unsure.
  • Use common sense — when in doubt, throw it out.
  • Do not consume food if you have any concern about safety.
